Footfall Survey

We can conduct footfall surveys for landlords and tenants or would be buyers or lessee’s ; to determine the actual footfall numbers on a site over a given period using actual operatives – often electronic means have been found to be in error. This can provide concrete data to support rent reviews.

The fact that we use qualified professional staff to conduct the surveys and prepare the reports enables them to stand in their own right as expert evidence or to be relied upon by solicitors and legal advocates.

Traditional non professionally qualified firms results are often open to criticism and may not be relied upon.

We were instructed by Michael Arbuckle UK Director of Muffin Break on a recent case:

A Muffin Break franchise was closed recently due to the franchisee going into administration and failing to meet debt commitments through falling sales. The original lease was agreed with representations from the landlord and the landlord’s agents on the basis of volumes of pedestrians provided by the landlord at the time over a weekly and annual period.

The represented counts provided by the landlord and landlord agents are in excess of 100,000-110,000 per week. Foodco UK LLP the owner of the Muffin Break franchise, contested these representations and believe that the actual count is significantly lower than this and therefore affected trading to such a detrimental level. If this is correct these numbers fall below the criteria for site selection for the Muffin Break system (90,000 or more is required per week).

Foodco UK LLP, after legal advice on the misrepresentations of traffic flow and issued instructions to us, with agreement and knowledge of the landlord’s legal team and their managing agents.

This count will enable a comparison to be made with the represented traffic counts.
